Asbestos - owners duties - duties for owners of building with asbestos:

According to current law regulations a person responsible for evaluation of technical condition of products containing asbestos is the owner or the administrator of the building, installation, technical device and a territory where such products are. Furthermore, the owner is obligated to carry out an inventory of all asbestos products.

Moreover, the owner or the administrator of the building or installation is responsible for:

• adequate marking of  places where  there are asbestos products,

• drawing up and and putting up in the right place warning information about asbestos danger,

Failure to fulfill the asbestos inventory obligation can result in a fine, which is imposed as a day rate and range from 10 zloty to 20,000 zloty. Magistrate's Court can impose a fine in amount not less than ten day rates but not bigger than 360 day rates.

It is based on the ACT of 27th April 2001 about wastes( Journal of Laws of 2001 no. 62 item 628 with changes) and Regulation of the Minister of Economy, Labour and Social Policy of 23rd October 2003 on requirements in the field of using and moving asbestos and using and clearing installations or devices in which there is or there was used asbestos ( Journal of Laws of 2003 no 192 item 1876).

TYPES OF ASBESTOS

According to Environmental Protection Agency there are 6 types of asbestos:

• chrysotile- the most popular, used first of all for production of asbestos-cement plates,

• krokidolit ( blue asbestos)- the most dangerous type as for its fibre, easy to breathe in structure,

• Amozyt ( brown asbestos) - used for textile products and pipe insulation,

• Anthophyllite - the most resistant for hight, temperature, easily inhale,

• Actinolite - belongs to the group of amphibolite asbestos coloured dark green to black. It is mineral of the greatest frangibility, rarely used,

• Tremolite - rarely used, can be found in talk and powder.
